From Joomla 3.0 to load JQuery javascript framework the correct way is to use Joomla API. You need to ask to your template provider to fix this error. Why it load own jQuery javascript framework? Probably this template keep (with a very bad way) a compatibility with Joomla 2.5.
Joomla APIs to load javascript framework are designed precisely to avoid conflicts, also keep in mind that all Joomla pages load jQuery framework, so it cause conflict, errors, and bad performance.
